END USER LICENSE AGREEMENT (EULA) & TERMS OF USE

This End User License Agreement ("Agreement") is a binding legal agreement between you and Haccoo (represented by Hakan Berk Balcılar). This Agreement governs your use of the application "Waqt" or any other applications (collectively, the "Application") made available through the Apple App Store or Google Play Store.

By installing or using the Application, you agree to be bound by this Agreement.

1. Acknowledgment & Parties

This Agreement is concluded between you and Haccoo only, and not with Apple Inc. ("Apple") or Google LLC ("Google"). Haccoo, not Apple or Google, is solely responsible for the Application and the content thereof.

2. Scope of License

Haccoo grants you a limited, non-exclusive, non-transferable, revocable license to use the Application for personal, non-commercial purposes on any mobile devices that you own or control.

For iOS Users: This license is subject to the Usage Rules set forth in the Apple Media Services Terms and Conditions. The Application may be accessed and used by other accounts associated with the purchaser via Family Sharing or volume purchasing.

For Android Users: This license is subject to the Google Play Terms of Service.

3. Subscriptions and Payments

Some features of the Application may be billed on a subscription basis.

  • Billing: Payment will be charged to your Apple Account or Google Play Account at confirmation of purchase.
  • Auto-Renewal: Your Subscription will automatically renew unless auto-renew is turned off at least 24-hours before the end of the current period.
  • Management: You can manage your Subscription and turn off auto-renewal by going to your Account Settings on the respective App Store after purchase.
  • Price Changes: We reserve the right to adjust pricing for our Service at any time.
  • Lifetime Access (One-Time Purchase): If you purchase a "Lifetime" plan, you are granted a license to access the specific Premium features available at the time of purchase for as long as the Application is available and supported by Haccoo ("Service Lifetime").

    Specific Terms for Lifetime Access:

    1. Definition of Lifetime: "Lifetime" refers to the operational life of the Application, not the life of the user. It does not imply that the Service will exist indefinitely.
    2. Service Termination: Haccoo reserves the right to modify, suspend, or discontinue the Application or the Service at any time for business or technical reasons. In the event that the Application is discontinued, your "Lifetime" access will terminate, and you will not be entitled to a refund of the one-time fee.
    3. Future Features: Lifetime access covers current Premium features and future updates that Haccoo, in its sole discretion, decides to include in this plan. It does not guarantee access to future major features, cloud-based services with significant recurring costs, or separate add-on products.

4. Maintenance and Support

Haccoo is solely responsible for providing any maintenance and support services for the Application. You acknowledge that neither Apple nor Google has any obligation whatsoever to furnish any maintenance and support services with respect to the Application.

5. Warranty

Haccoo is solely responsible for any product warranties, whether express or implied by law.

For iOS Users: In the event of any failure of the Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Application.

6. Product Claims

You and Haccoo acknowledge that Haccoo, not Apple or Google, is responsible for addressing any claims relating to the Application or your possession and/or use of the Application, including: (i) product liability claims; (ii) any claim that the Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or privacy legislation.

7. Intellectual Property Rights

In the event of any third-party claim that the Application infringes that third party's intellectual property rights, Haccoo, not Apple or Google, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.

8. Legal Compliance

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

9. Third Party Terms of Agreement

You must comply with applicable third-party terms of agreement when using the Application (e.g., you must not be in violation of your wireless data service agreement).

10. Third Party Beneficiary

For iOS Users: You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this Agreement. Upon your acceptance of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary thereof.
